Getting a Divorce in Las Vegas

Getting a Divorce in Las Vegas

When you get a divorce in Las Vegas Nevada, you can find that it affects everyone involved. Not only the husband and wife but also any children, close family and even friends.

If you make claims of infidelity that cannot be proven against your spouse, they will be given the chance to defend themselves but infidelity is not a cause of action for a divorce. A divorce can cause a huge divide which is of course something no one will want.

Because Nevada State is one that has a no-fault option, people are able to divorce without having to go through the painful process of blaming one another for the parting. This allows them to end their marriage due to irreconcilable differences.  It is also a state where the law will mostly allow any debts or property to be divided between the divorcing couple rather than one ex-partner set to lose more than the other. This is not always the case, but it is more common than not due to Nevada being a community property state.

James M Davis Law Office can help you to get the relevant evidence you need where possible to make the divorce process as easy as possible even in the most difficult situation. They are sensitive to claims of domestic violence and mental torment and if necessary will work with the relevant authorities to get the information and paperwork to prove the allegations.

You also can file for a divorce on specific grounds if relevant such as insanity, which must have existed for two years before taking action and supported by a doctor’s diagnosis. Just because you may believe that your spouse is insane, that may not be the case. Of course this is a delicate matter which is why James M. Davis Law Office will provide the support and legal advice you need from beginning to end.
If you have lived apart from your spouse for at least a year without rekindling the relationship or cohabiting during this time, it is at the courts discretion as to whether they will grant a divorce.  James M Davis Law Office can help their clients through this process and give advice throughout to make things as easy as possible in this difficult situation.

James M. Davis Law Office is able to provide you with the expertise and advice you need to go through the divorce process all while being sympathetic to the needs of their client(s) and their individual situation. They are able to give you expectations that are realistic which will avoid disappointment. This allows you to plan how you are going to spend the remainder of your life once the divorce papers are served.

What is Family Court

James M Davis Law Office Family Law

Family Court in Las Vegas is overseen by twenty elected judges and part of the Eighth Judicial District Court.  The Family Court is a specialized court for the purpose of resolving legal issues concerning family law.

WHO GOES TO FAMILY COURT

If you find yourself in need of divorce, child custody, visitation rights, child support, name change, adoption, spousal support, community property issues, or guardianships your case will be heard at the Family Court Division.  The Family Court is also responsible for issuing Temporary Protection Orders when protection is needed from a family member.

WHERE IS FAMILY COURT

James M Davis Law
The Family Court House in Las Vegas is located at 601 N PecosRoad. Parking is in the front of the building, with the entrances on Pecos.  Parking can be a bear so be sure to give yourself plenty of time before your hearing.  Three (3) of our Family Court Judges have their courtrooms in the Regional Justice Center.  Check with your attorney or the court to be sure you go to the correct building.

WHAT SHOULD I DO WHEN I GET TO FAMILY COURT

Upon entering family court all persons will be guided through a detector, no guns or knives are permitted in family court.  Family Courtroom numbers are clearly marked but the numbers do not correspond with the assigned Department, check with your attorney or the information to locate the correct court room.  Once you find the correct court room be seated in the waiting area until your attorney greets you or you are called into session by the Marshall.

WHAT DOES FAMILY COURT LOOK LIKE

Family Court Room is similar to any Court Room where as there is a judge, Marshall and Court Clerk.  Your attorney will direct you and your witnesses where to sit once your case has been called into the Court Room.

RESPECTING FAMILY COURT

James M Davis Law OfficeDRESS CODE

Last week a study titled "Marriage: More Than A Century Of Change," conducted by Bowling Green State University National Center for Marriage and Family Research (NCFMR), found that the number of divorced or separated women in the US had risen 14% since 1920.

Researchers used data from the National Vital Statistics, Decennial Census, and American Community Survey and concluded that divorce was on the rise in America.

“The divorce rate remains high in the U.S., and individuals today are less likely to remarry than they were in the past,” Dr. Susan Brown, co-director of the NCFMR, told a press conference

Cultural changes and attitudes toward divorce have changed drastically since the 20's, which could attribute to the rise in more women choosing divorce. Gone are the days of the social pressures and obstacles surrounding divorce, especially in the case of women.

Past research has indicated that women file for divorce more often than men. According to a report titled "'These Boots Are Made For Walking': Why Most Divorce Filers Are Women," published by the American Law and Economics Review in 2000, women filed more than two-thirds of divorces in the U.S.

In addition, studies have found that other demographics have seen a rise in divorce. According to data published by the American Academy of Matrimonial Lawyers in June of this year, people over the age of 50 are ending their marriages more frequently than in the past.

While a divorce is never fun, today's couples have more choices available to them than they did 50 years ago. Knowing your legal options is half of the battle and we at James M Davis Law Office are here to help you navigate through the entire process.
